Terms and conditions
1.1 These terms and conditions for the use of this online store (hereinafter referred to as the “Terms”) are a legally binding document establishing the mutual rights, obligations, and liability of the Buyer (hereinafter referred to as the “Buyer”) and the Seller, SensoryLearningFUN (hereinafter referred to as the “Seller”), when the Buyer purchases goods and/or services in the Seller’s online store “SensoryLearningFUN” (hereinafter referred to as the “Store”).
1.2 The Terms apply whenever the Buyer uses the Store in any way or form: submits personal or other data, places an order for goods offered in the Store and pays for such goods, reads the information provided in the Store, or otherwise uses the online store (hereinafter collectively referred to as the “Services”).
1.3 The Buyer is not given the opportunity to place an order for goods in the Store unless the Buyer has familiarized themselves with the Terms. In all cases, the Buyer shall be deemed to have familiarized themselves with and agreed to the Terms if, before ordering goods, they confirm their agreement to the Terms by ticking the box next to the statement “I confirm that I have read and agree to the terms and conditions.” In cases where the Buyer partially or fully disagrees with all or any part of the Terms, the Buyer shall not have the right to use any of the Services available at SensoryLearningFUN. Otherwise, it shall be deemed that the Buyer has familiarized themselves with and unconditionally agreed to all of the Terms.
1.4 The Store shall be released from any liability in cases where losses arise because the Buyer, despite having been given the opportunity, failed to familiarize themselves with the Store’s Terms, disregarding the recommendations provided to them and their own obligations.
1.5 The Seller reserves the right to amend the Terms at any time. The Terms in force at the moment of placing the order shall apply to the Buyer.
1.6 The following persons are entitled to purchase from SensoryLearningFUN:
1.6.1 Natural persons over 18 years of age whose legal capacity has not been restricted by court order, as well as their authorized representatives. Natural persons under 18 years of age may purchase goods at SensoryLearningFUN only with the consent of their parents or guardians;
1.6.2 Legal entities and their authorized representatives.
2. Privacy Policy
2.1 When placing an order, the Buyer must provide their personal data required for the execution of the order: the Buyer’s full name, the address to which the goods will be delivered, the email address to which informational messages about the order status will be sent, the Buyer’s telephone number, the methods of delivery and payment for the goods, and other information necessary for the Seller to provide the Services.
2.2 Any information related to personal data provided by the Buyer for the purpose of executing the order shall be considered confidential and shall not be made public. The Seller undertakes not to disclose such information to third parties, except to the Seller’s partners providing services related to the ordering, payment, and delivery of goods, or other services related to the submission or execution of the Buyer’s order. Any other exceptions regarding the disclosure of the Buyer’s personal information to third parties shall in all cases be coordinated with the Buyer. In all other cases, any of the Buyer’s personal data may be disclosed to third parties only in cases provided for by the laws of the Republic of Lithuania.
2.3 By registering at SensoryLearningFUN and ordering goods, the Buyer undertakes to protect and not disclose their login data to anyone, and after using the Store’s Services, the Buyer must log out of the SensoryLearningFUN system. At the same time, the Buyer confirms that they are of legal age and have the right to order goods in the Store. If the Buyer discloses their login data to third parties or fails to log out of the SensoryLearningFUN system after using the Store’s Services, the Seller shall be released from any liability related thereto.
2.4 By registering at SensoryLearningFUN, the Buyer confirms that they grant the Seller the right to collect, accumulate, systematize, use, and process in any manner not prohibited by the laws of the Republic of Lithuania any and all personal data that the Buyer directly or indirectly provides to the Seller while visiting SensoryLearningFUN and using the Services, in accordance with the conditions and procedures established in these Terms.
2.5 The Seller confirms that by registering at SensoryLearningFUN, the Buyer does not grant the right to use their email address, telephone number, address, or other personal data for marketing purposes, except in cases where the Buyer themselves indicates during registration that they wish to receive such information.
2.6 By familiarizing themselves with the Terms, the Buyer confirms that they have been informed that, while browsing the Store, files sent from an internet server will be placed on their computer.
2.7 The Seller has the right at any time, without prior notice, to restrict or suspend the Buyer’s ability to use the Seller’s Services. The Seller also has the right to terminate the operation of the Store without informing the Buyer.
3. Order Confirmation and Conclusion of the Purchase–Sale Agreement
3.1 The Buyer’s order shall be deemed confirmed and the purchase–sale agreement between the Buyer and the Seller shall be deemed concluded from the moment when the Buyer, after familiarizing themselves with the Terms on SensoryLearningFUN, creates a shopping cart, provides their personal data, selects a payment method, and clicks the “Confirm order” button.
3.2 Each agreement concluded between the Buyer and the Seller shall be stored in the SensoryLearningFUN database.
4. Buyer’s Rights and Obligations
4.1 The Buyer has the right to purchase goods at SensoryLearningFUN in accordance with the Terms.
4.2 The Buyer must accept the ordered goods and pay the price of the goods and their delivery.
4.3 The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided in the registration form.
4.4 The Buyer must protect their login data for the online store and not disclose it, ensure that the data is known only to them and used only by them. If there is any suspicion that the login data may have become known to another person, the Buyer must immediately inform the Seller. All actions performed using the Buyer’s identification code shall be deemed to have been performed by the Buyer, and the Buyer assumes full responsibility for the consequences of such actions.
4.5 If the data provided in the Buyer’s registration form changes, the Buyer must update it immediately.
4.6 The Buyer must use SensoryLearningFUN for its intended purpose, without harming its operation and stable functioning.
5. Seller’s Rights and Obligations
5.1 If the Buyer attempts to harm the operation or stable functioning of the online store, the Seller shall have the right at any time, without prior notice, to cancel the Buyer’s registration, restrict, or suspend the Buyer’s ability to use the Seller’s Services.
5.2 The Seller has the right to temporarily or indefinitely terminate the operation of SensoryLearningFUNwithout informing the Buyer.
5.3 The Seller must create conditions enabling the Buyer to properly use the services provided by the online store.
5.4 The Seller must deliver the goods ordered by the Buyer to the address specified by the Buyer in the order.
5.5 If, due to important circumstances, the Seller is unable to deliver the ordered goods to the Buyer, the Seller undertakes to offer the Buyer an analogous product, and if the Buyer refuses to accept the analogous product or if no analogous product is available, to refund the Buyer’s paid money within 7 business days. In this case, the Seller shall be released from liability for non-delivery of the goods.
5.6 The Seller must protect the data provided by the Buyer and use it only for the purposes of selling and delivering goods, without violating the requirements for personal data protection established by the laws of the Republic of Lithuania.
5.7 If the Seller’s online store contains links to websites of other companies, institutions, organizations, or persons, the Seller shall not be responsible for the information contained therein or for the activities carried out there.
6. Goods and Pricing
6.1 The characteristics and price of each product are provided next to each product at SensoryLearningFUN.
6.2 Prices at SensoryLearningFUN and in the order are indicated in EUR. Value Added Tax (VAT) is included in the product price.
6.3 The Seller states, and the Buyer by familiarizing themselves with the Terms confirms, that the goods indicated at SensoryLearningFUN may, in terms of color, shape, or other parameters, differ from the actual size, shape, and color of the goods due to the characteristics of the display used.
6.4 The Seller reserves the right to change the offer of goods and prices at SensoryLearningFUN at any time.
6.5 The Seller undertakes to provide the Buyer with the quantity of goods specified in the order and of suitable quality. The Seller assumes no liability in cases where the quantity of delivered goods is inaccurate due to the Buyer incorrectly filling out the order.
7. Payment Procedure and Deadlines
7.1 The Seller shall begin processing the order only after receiving full payment from the Buyer for the Services, unless otherwise agreed by email.
7.2 The Buyer must pay for the Services no later than within three business days after order confirmation and conclusion of the purchase–sale agreement, unless otherwise agreed by email.
7.3 The Buyer may pay for the ordered goods using one of the methods specified in the Store:
7.3.1 By advance bank transfer, independently logging into the online banking system of the bank chosen by the Buyer;
7.3.2 Using the Paysera payment initiation service, payment can be made through the following banks: Swedbank, SEB, Luminor, Citadele, Šiaulių bankas, Medicinos bankas, Revolut, Paysera.
7.4 The Seller undertakes to provide all correct information necessary for full payment for the Services. However, the Seller assumes no liability whatsoever for poor-quality services provided by banks or the Mokejimai.lt system (this system is administered by “EVP International”, UAB, Mėnulio g. 7, LT-04326, Vilnius, Lithuania; Company code 300060819, VAT code LT100001261114), or for losses arising therefrom. The Seller also assumes no liability for losses arising from mistakes made by the Buyer when forming and executing the payment (e.g. entering an incorrect account number, providing an incorrect order code, etc.).
8. Delivery of Goods
8.1 Goods are delivered at the Buyer’s expense by UAB “Baltic Post” LP EXPRESS courier service and LP Express parcel terminals.
8.2 The Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances. In such a case, the Seller undertakes to immediately inform the Buyer and indicate the delivery deadline.
If the ordered goods are not in the Seller’s warehouse and must be ordered from suppliers, the Buyer shall be informed about the preliminary delivery time by a separate email message.
8.3 Goods available in stock are delivered to the address specified by the Buyer within 2–5 business days in Lithuania and within 5–10 business days in European Union countries (unless otherwise stated) from the receipt of payment for the goods and their transportation. (This depends on the selected delivery method.)
8.4 Upon delivery of the goods, the Buyer must, together with the representative of the transport company or the Seller, inspect the condition of the shipment and, if any damage is noticed, indicate it in the document confirming delivery of the shipment. If the Buyer accepts the shipment and signs the delivery confirmation document without comments, it shall be deemed that the delivered shipment is free from defects.
8.5 Once the goods are delivered to the address specified by the Buyer, the goods shall be deemed transferred to the Buyer. If the goods are not delivered on the planned delivery date, the Buyer must immediately, but no later than the day following the planned delivery date, inform the Seller thereof. Otherwise, the Buyer loses the right to make claims against the Seller related to the delivery of the goods.
8.6 If the Customer notices that the goods do not meet the requirements specified in the order, the Customer undertakes to contact the Seller immediately, but no later than the day following the delivery date, by phone or email. The Seller undertakes to take all actions necessary to remedy the existing deficiencies, if such deficiencies arose due to the fault of the Seller or third parties acting on the Seller’s behalf.
9. Return of Goods
9.1 Returns of goods are carried out in accordance with Order No. 258 of the Minister of Economy of the Republic of Lithuania of August 17, 2001, “On the Approval of the Rules for the Sale of Goods and Provision of Services When Contracts Are Concluded Using Means of Communication,” and Order No. 217 of the Minister of Economy of the Republic of Lithuania of June 29, 2001, “On the Approval of the Rules for the Return and Exchange of Goods.”
9.2 If the Buyer purchases a product of inadequate quality, the Buyer has the right to return such product to the Seller within 7 (seven) business days from the date of its delivery to the Buyer. In such a case, the product of inadequate quality shall be replaced free of charge with a quality product, or the money paid shall be refunded to the Buyer.
9.3 Exchange or return of goods shall be carried out upon receipt of a request from the Buyer, which must indicate what is being returned or exchanged, the order number, and the reason for the return or exchange.
9.4 In cases where goods are exchanged and a price difference arises during such exchange, the Buyer must pay the price difference. The price difference shall be paid by transfer to the specified bank account. In cases where the Seller cannot replace the goods because the required goods are unavailable, the Buyer shall be refunded the amount paid, excluding the delivery charge.
9.5 In all cases, the Buyer must return the goods in the original product and shipment packaging. The document confirming the purchase from SensoryLearningFUN and a completed “Product Exchange/Return Form” must be enclosed together with the exchanged or returned product.
9.6 The Buyer is responsible for assembling and packaging the exchanged/returned goods. If the item is not fully комплектed and/or properly packaged, the Seller will not accept the returned item.
9.7 The Buyer may exercise the right to return a product only if the product has not been used, its consumer properties have been preserved, it has not been damaged, and it has not lost its commercial appearance. The product must be delivered in intact original packaging. Changes to the appearance of the product or its packaging that were necessary in order to inspect the product shall not be considered essential changes to the product’s appearance.
9.8 The costs of transportation or sending the goods shall be borne by the Buyer, except in cases where the goods are returned due to inadequate quality or a manufacturing defect.
9.9 Upon receipt of the exchanged or returned goods, the Seller undertakes within 7 days to replace the goods or refund the money paid for them, provided that the goods met the requirements applicable to exchanged/returned goods set out in clause 9.7.
9.10 Defective goods are exchanged and returned in accordance with the Rules for the Return and Exchange of Goods approved by Order No. 217 of the Minister of Economy of the Republic of Lithuania of June 29, 2001, “On the Approval of the Rules for the Return of Goods,” except in cases where the contract cannot be withdrawn from under the laws of the Republic of Lithuania (see information on the website of the public institution “Vartotojų centras” under “Specific Features of Return and Exchange of Non-food Goods,” clause 18). Under this clause, products that are of good quality but have options for color, size, or design are classified as non-returnable products.
9.11 Each product is covered by the supplier’s warranty for manufacturing defects and other defects not related to normal use of the product and environmental effects. The warranty period for each product is provided in the product description.
10. Final Provisions
10.1 All disputes arising from or related to the purchase–sale agreement between the Buyer and the Seller shall be settled through negotiations. If no agreement is reached, disputes shall be resolved in the courts of the Republic of Lithuania according to the location of the Seller’s registered office.
